These Terms and Conditions outline the rules and regulations for using Connect SPP LLC’s mobile application, Peaches’nCream, available on the Apple App Store and Google Play Store. By downloading and using this app, you accept these terms. If you do not agree, please refrain from using Peaches’nCream.

Terminology

The following terminology applies to these Terms and Conditions, Privacy Policy, and any other notices:

  • “Client,” “You,” and “Your” refer to you, the individual using this app.
  • “The Company,” “Ourselves,” “We,” “Our,” and “Us” refer to Connect SPP LLC.
  • “Party,” “Parties,” or “Us” refer to both the Client and the Company.

Please also review our Privacy Policy, which explains how we collect, use, and protect your personal information. By using Peaches’nCream, you agree to the terms of our Privacy Policy, in addition to these Terms and Conditions.

User Account Provisions

Each individual is permitted to create only one account, which is non-transferable. We reserve the right to suspend or terminate accounts for the following reasons:

  • Violation of these Terms
  • Fraudulent activity
  • Creation of multiple or duplicate accounts
  • Conduct that threatens the integrity of the platform

You are responsible for keeping your account credentials confidential and agree to notify us immediately if you become aware of any unauthorized use of your account.

User Responsibilities

You are responsible for your interactions and the content you post on Peaches’nCream. You must:

  • Treat all members with respect and engage positively.
  • Use the reporting and blocking features to maintain a safe environment.
  • Only share content that is respectful, appropriate, and considerate, and refrain from posting anything unlawful, offensive, insensitive, upsetting, distasteful, or disturbing. Examples of such content include:
    • Defamatory, discriminatory, or mean-spirited content, including references or commentary about religion, race, sexual orientation, gender, national/ethnic origin, or other targeted groups, particularly if the app is likely to humiliate, intimidate, or harm a targeted individual or group. Professional political satirists and humorists are generally exempt from this requirement.
    • Realistic portrayals of people or animals being killed, maimed, tortured, or abused, or content that encourages violence. “Enemies” within the context of a game cannot solely target a specific race, culture, real government, corporation, or any other real entity.
    • Depictions that encourage illegal or reckless use of weapons and dangerous objects, or facilitate the purchase of firearms or ammunition.
    • Overtly sexual or pornographic material, defined as “explicit descriptions or displays of sexual organs or activities intended to stimulate erotic rather than aesthetic or emotional feelings.”
    • Inflammatory religious commentary or inaccurate or misleading quotations of religious texts.
    • Harmful concepts which capitalize or seek to profit on recent or current events, such as violent conflicts, terrorist attacks, and epidemics.

User-Generated Content

You retain ownership of the content you upload, including images, videos, and text. By uploading content, you grant Connect SPP LLC a non-exclusive license to use, reproduce, and edit your content in any form or media. You warrant that:

  • You have all necessary licenses and consents to post the content.
  • Your content does not violate any intellectual property rights or privacy laws.
  • Your content is not unlawful, offensive, insensitive, upsetting, distasteful, or disturbing.

Please note that all information you share on the Peaches’nCream app is accessible to other members. While we implement robust security measures to protect your content, no system is entirely secure, and unauthorized access may occur. We primarily serve as a platform for sharing content and do not actively monitor or censor submissions. However, if we receive notifications about illegal content or violations of our community guidelines, we may take appropriate action. Sharing information on Peaches’nCream is done at your own risk.

Third-Party Links and Services

Our platform may include links to external websites or services, but we are not responsible for the content or practices of these third-party sites. External links do not imply endorsement, and users interact with third-party services at their own risk.

Acceptable Use Policy

You agree not to:

  • Post sexual content without appropriate content settings using the spicy/vanilla toggle)
  • Engage in harassment or bullying
  • Create content that exploits or sexualizes minors
  • Impersonate other users or use fake identities
  • Distribute malware or harmful code
  • Attempt to circumvent security measures
  • Collect or store personal information of other users without consent

We reserve the right to:

  • Remove content that violates these terms
  • Suspend or terminate accounts without prior notice
  • Cooperate with legal authorities in investigations

Peaches’nCream employs reasonable technical measures to protect the integrity and security of your personal information. However, we cannot guarantee absolute security for any data you choose to share or publish through our platform, and you acknowledge this inherent risk. While we strive to safeguard our systems, we cannot assure that your data will remain secure from unauthorized access, disclosure, alteration, or destruction due to potential breaches of our physical, technical, or administrative safeguards.

Notification of Security Breaches

In the event of a security breach involving our systems, we will make an effort to notify you electronically, enabling you to take any necessary precautions. While we might post a notice on our website if a breach occurs, we are not obligated to do so. Depending on your jurisdiction, you may have the legal right to receive written notification of any security incidents. Dispute Resolution

Any disputes arising from the use of Peaches’nCream will first seek informal resolution. If necessary, binding arbitration will take place in Maricopa County, Arizona, and will follow the rules set by the American Arbitration Association. Both parties will bear their own legal costs, and class action waivers apply—meaning disputes will be resolved individually. The governing law for any arbitration or legal proceeding will be the laws of the State of Arizona.

Limitation of Liability

Connect SPP LLC is not liable for any interactions or content generated by users. Each user is solely responsible for their own content and interactions.

Changes to Terms

We reserve the right to amend these terms at any time. Users will be notified of significant changes, and continued use of the app signifies acceptance of the updated terms.

Severability and Entire Agreement

If any provision of these Terms is found to be invalid, the remainder of the Terms will remain in full effect. These Terms constitute the entire agreement between you and Connect SPP LLC, and any previous versions are superseded by the current version.
